PriveGen.com ("Service", "Platform", "we", "us", or "our") provides AI-powered content generation tools and services. Our platform enables users to create AI-generated images, videos, and other digital content through various AI models in a private, secure environment. Unlike public platforms, your creations remain private and are not displayed publicly or shared with other users without your explicit consent.

2. Acceptance of Terms

By accessing or using PriveGen.com, you ("User", "you", or "your") agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

3. User Eligibility

• You must be at least 18 years old to use this Service
• You must comply with all applicable local, state, national, and international laws and regulations
• You may not use the Service if you have been previously banned or suspended

4. Privacy and Content Ownership

4.1 Your Content Remains Private

All content you generate using our Service remains private to your account. We do not display, share, or make your generated content publicly available. Your creations are stored securely and accessed only by you unless you explicitly choose to share them outside the platform.

4.2 Content Ownership

You retain ownership of the content you generate using our Service. By using our Service, you grant us a limited, non-exclusive license to process, store, and deliver your content solely for the purpose of providing the Service to you.

4.3 Content Retention and Privacy

By default, we only keep your generated content for 30 minutes on our servers for your convenience. We offer optional extended storage, but this is entirely at your discretion. We do not log usage or visit information, track IP addresses, or collect device data. For maximum privacy, we offer email-free accounts and accept Monero payments for fully anonymous usage.

5. Prohibited Content and Use

You agree not to generate, upload, or use our Service for content that:

• Depicts real people: Content using the likeness of real, identifiable individuals without their consent
• Involves minors: Any content sexualizing or depicting minors in inappropriate contexts
• Illegal activities: Content depicting illegal acts, violence, or criminal behavior
• Copyright infringement: Content that violates intellectual property rights of others
• Harmful or deceptive: Content intended to deceive, defraud, or harm others
• Extremist content: Content promoting terrorism, extremism, or dangerous ideologies
• Non-consensual intimate content: Deepfakes or intimate content created without consent

6. User Responsibilities

• Ensure all prompts and generated content comply with these Terms and applicable laws
• Respect intellectual property rights and use only content you have the right to use
• Maintain the security of your account credentials
• Report any suspected violations of these Terms
• Use the Service responsibly and ethically

7. Content Moderation and Enforcement

We employ automated systems to detect and prevent the generation of prohibited content. These systems may flag or block certain prompts or generated content.

8. Service Availability and Limitations

• We strive to maintain high service availability but cannot guarantee uninterrupted access

• Beta features are provided "as-is" without warranties

9. Payment and Subscriptions

9.1 Payment Methods

We accept both traditional payment methods through Stripe and anonymous payments via Monero (XMR) cryptocurrency. Monero payments enable fully anonymous usage when combined with email-free accounts.

9.2 Billing

Subscription fees are billed in advance and are non-refundable except as required by law or as specified in our refund policy.

9.3 Usage-Based Charges

Additional charges may apply for usage exceeding plan limits. You will be notified before incurring such charges.

9.4 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.

• You may download your content within 30 days of termination
• We may delete your account and content after the grace period
• Sections of these Terms that should survive termination will remain in effect

We may update these Terms from time to time. Material changes will be communicated via email or platform notification. Continued use of the Service after changes constitutes acceptance of the new Terms.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of Wyoming, United States. Any disputes shall be resolved in the courts of Wyoming. We chose Wyoming for its strong privacy protections and business-friendly regulatory environment.
